The Human Rights Committee of the Nigerian Bar Association (NBA), Benin Branch, has issued a statement expressing deep concern over the recent mass arrests and arraignments of young people in Edo State, purportedly as part of efforts to combat cultism. The NBA branch emphasized the need for law enforcement to adhere to the rule of law and due process.
The statement, jointly released on Thursday by Branch Vice Chairman Ekama Itohan, who also chairs the Human Rights Committee, and Committee Secretary Emmanuel Okorie, acknowledged the importance of addressing cultism but cautioned against violating fundamental rights in the process.
“While commending efforts to tackle the menace, the committee emphasised that such efforts must be grounded in the rule of law, respect for human rights, and due process,” the statement read.
The committee raised concerns that many individuals are being brought before the court without adequate investigation or compelling evidence linking them to alleged offenses. They argued that such practices undermine the judicial system and violate the rights of the accused.
“The approach undermines the integrity of the judicial system and violates the fundamental rights of the accused,” the committee noted.
The NBA Benin Branch underscored the necessity of thorough investigations by law enforcement agencies before bringing charges against individuals. They further stressed the importance of courts dispensing justice based on credible evidence, warning against perpetuating human rights violations.
“The NBA urges the relevant authorities to ensure that all actions taken in the fight against cultism strictly adhere to the law,” the statement continued.
Furthermore, the committee called on the courts to strictly adhere to the Administration of Criminal Justice Law of Edo State 2018 by demanding proof of evidence before remanding suspects.
“It also called on the courts to demand proof of evidence before remanding suspects, in compliance with the Administration of Criminal Justice Law of Edo State 2018.”
The NBA Benin Branch expressed its willingness to collaborate with all stakeholders to ensure that anti-cultism efforts do not infringe upon the rights of innocent individuals.
“We stand ready to work with all stakeholders to ensure that our efforts to combat cultism do not infringe on the rights of innocent individuals. Human life and dignity matter, and we must not compromise on the values of justice, fairness, and respect for human rights.” the statement declared.
